What Are Weapons Offenses?
Weapons charges fall into two main categories:
- Weapons charges that involve the weapons themselves as part of the charge, such as possession of an illegal firearm (e.g., machine gun or automatic assault weapon), illegal possession of a firearm (e.g., no license to carry a firearm) and trafficking weapons and illegal firearms.
- Weapons charges that involve the use of a weapon in the commission of a crime, sometimes referred to as 10/20/Life laws. These weapons charges include assault with a deadly weapon, shooting, attempted murder with a weapon, homicide and armed robbery.
10/20/Life Laws
Any felony committed with a weapon can subject someone to significant periods of incarceration. However, many crimes involving firearms are also subject to the 10/20/Life minimum mandatory statutes. If this statute applies to the crime, there is a ten year mandatory for possessing the firearm in the commission of the crime, a 20 year minimum mandatory for discharging the firearm, and a 25 year minimum mandatory, with a potential life sentence, for injuring or killing someone with a firearm during the commission of the crime.
