What is a Misdemeanor?

In Florida, a misdemeanor is any crime punishable by up to one year in jail that can carry the following sanctions:

  • Time in county jail
  • Probation
  • A combination of the two
  • A fine of up to $1,000

What is a Felony?

A felony is a crime heard in circuit court that may be punishable by more than one year of sanctions, and can include the following punishments, depending on the severity of the charge:

  • Up to 15 years in state prison and a $10,000 fine for a second degree felony
  • 30 years in prison or life in prison for a first degree felony
  • Death for a capital offense
