Bills that have passed in the State Legislature relating to criminal offenses

House Bill 43 - Gang member registration upon certain convictions; other gang legislation including bulletproof vests during commission of crimes. Effective 10/1/8

House Bill 61 - Amends 776.051 to prohibit resisting an officer with violence if the officer is acting in "good faith." Previously the State had to prove the officer WAS performing a legal duty. Effective 7/1/8

House Bill 173 - Defines cultivation for chapter 893 and legislation involving this subject. Effective 7/1/8

House Bill 225 - Criminalizes entering false information into your caller ID when calling others. Effective 10/1/8

House Bill 313- The "Barwick-Ruschak" Act, essentially making "dating violence" equivalent to "domestic violence" for law enforcement procedures etc. Effective 10/1/8

House Bill 321 - Mandatory life sentences for murder of any degree, or attempted 1st, 2nd, or felony murder, of a law enforcement officer. Effective 10/1/8

House Bill 537 - Amends 810.145 video voyeurism statute, making it a felony for victims under certain ages. Effective 7/1/8

House Bill 559 - Amends chapter 847 regarding distribution of obscene materials to minor. Effective 7/1/8

House Bill 743 - Regarding mortgage fraud. Effective 7/1/8

House Bill 799 - Theft of copper and other non-iron metals from utility companies. Effective 10/1/8

House Bill 1417 - Act regarding counterfeiting of trademarked goods. Effective 10/1/8

Senate Bill 92 - Criminalizes failing to render medical aid to the victim of a crime if done with the intent to hinder, delay or obstruct the investigation into the crime which caused the injuries. Effective 10/1/8

Senate Bill 0366 - Reclassifies elderly abuse as a 1st degree felony from 2nd degree felony. Effective 07/01/08

Senate Bill 0622 - Restates the obvious-that people accused of serious crimes shall not have contact with the victim during their sentences. Effective 10/1/8

Senate Bill 1442 - Allows the use of a pseudonym for the victim in child sex case and child abuse prosecutions; moves lewd exhibition via computer from 800.04 to 847.0135; enacts 847.002 regarding sending all suspected child pornography images to the national Child Victim Identification Program for indexing and identification; creates 847.01357 giving identified victims of child pornography a civil remedy against child pornography producers and people who possess such images; creates 960.197 giving victim rights for victims of child pornography; amends the Williams Rule portion of the evidence code, 90.404(2) to include 847.0135(5) under the more liberal rules of admissibility for people accused of child molestation; amends the PRR and VCC statute, 775.082, to include 847.0135(5) as eligible offenses; amends statute of limitations for child sex crimes to include 847.0135(5); amends sexual predator statute, 775.21, to include 847.0135(5) as an eligible offense; amends 787.025 to include 847.0135(5) in the luring/enticing a child statute; amends 794.065 to include 847.0135(5) to eligible statutes for unlawful places of certain convicted sex offenders to live; sets 847.0135(5)(c) as a 3rd degree felony, level 4 on the CPC scoresheet; sets 847.0135(5)(b) as a 2nd degree felony, level 5 on the CPC scoresheet; amends 947.1405 to include 847.0135(5) to the offenses for "conditional release programs"; amends 948.06 violation of probation statute to include 847.0135(5); amends 948.30, conditions of sex offender probation, to include 847.0135(5); amends 948.31, the diagnosis and evaluation of sex offenders, to include 847.0135(5). Effective 10/1/8

Senate Bill 1992 - Criminalizes being a "spectator" at an illegal road race. Increased driver's license penalties for commercial drivers who are found guilty of DUI. Effective 07/01/08

Senate Bill 1998 - Amends DWLS Statute 322.34(10). Effective 7/1/8

Senate Bill 2676 - requires a list of everyone on pretrial release to be posted at each Clerk of the Court's office. Effective 07/01/08
